Terms and Conditions of use
Fatamadrina is a surface design studio primarily operating online through the website www.fatamadrina.eu (hereinafter referred to as “the website”).
Access to and use of the website www.fatamadrina.eu are subject to acceptance of the following terms and conditions.
By making a purchase, the buyer expressly agrees to the terms outlined in this document.
Use of the website
The use of the website is intended for companies and professionals.
The website is visible to everyone, but, in order to proceed with purchases, it is necessary to create an account and be a registered user.
Different types of products can be purchased through the website:
- graphics (illustrations, patterns, matching graphics, complete kit);
- consultancy packs for creating customised graphics based on the client's specifications, with predefined costs, quantities and timeframes.
It is also possible to arrange fully personalised consultations, in terms of timeframes, methods of execution, and costs.
Each product is accompanied by images and a technical sheet that describes its features. The user is required to read this sheet before making a purchase. Once the purchase is completed, as the products are digital, there is no possibility of return or refund.
The products are sold as described, and the client cannot request any modifications to the downloaded files from Fatamadrina.
There is a product available on the website that can be downloaded for free, which represents an example of the structure of our files. Each user can view and download this product to verify that the technical characteristics of our graphics meet their needs.
Unless otherwise specified, the logo, photos and designs on the website are the property of Fatamadrina and it is prohibited to copy and/or reproduce them in any form.
Remarks on product colours
The colour palette that we propose for each graphic is created based on Pantone Fashion, Home + Interiors colours, and then adapted to CMYK.
Colours may appear differently depending on the monitor.
Since it is a digital simulation, the colours displayed on the screen may differ once printed.
We recommend verifying that the proposed colours are suitable for your collection before printing or proceeding with production.
Remarks on consultancy packs
It is possible to purchase pre-set personalised consultancy packs on the website (e.g., a personalised design of an illustration, a pattern, etc.).
Please note that the consultancy request must be consistent with Fatamadrina’s activities (designs for children). We reserve the right to decline requests that we deem inappropriate. In such cases, the full amount paid will be refunded.
In case of any doubt, users are encouraged to contact us for clarification before purchasing a consultancy pack.
Product usage rights/licences
With the purchase of a product the user acquires an unlimited usage right to use the product, under the following conditions:
- The graphics are intended for products associated with the world of children (e.g., clothing, textiles, stationery, home décor or accessories).
- The user may use the graphics as they are or make minor modifications, such as changing text or colours.
- The graphics may be part of a more elaborate project created by the purchaser, who commits to not altering or distorting the intended purpose of the graphics, i.e. their use in products related to the world of children.
- In any case, the purchaser undertakes to maintain consistency with Fatamadrina’s style, particularly by avoiding modifications that could result in contents that are offensive, unlawful, or immoral.
The website offers products with two types of usage rights/licences: exclusive and non-exclusive. The type of right/licence is clearly indicated on the product sheet before purchase.
Non-exclusive usage right/licence
The purchase of a product and the acquisition of the usage right does not guarantee any exclusivity to the purchaser. Fatamadrina reserves the right to grant other purchasers non-exclusive usage rights for the same graphics purchased by the user.
Exclusive usage right/licence
If a product is available for exclusive purchase, the user will have the opportunity to purchase it and Fatamadrina will immediately remove it from the available products for sale, ensuring that no other user can purchase it.
If a product is being sold with an exclusive usage right, this means that the file has never been purchased by others, although we cannot guarantee that the product page has not already been viewed by someone else.
Products involving personalised consultancy will always have an exclusive usage right.
Resale or transfer of images
The usage rights/licences acquired do not include the possibility of reselling the image in any form, even after any modifications have been made. The images must be used exclusively for printing or reproducing on children’s clothing products or other objects and accessories related to the world of children. Reselling the images as purchased to third parties is strictly prohibited.
Once the user has purchased an image, they acquire the right to use it exclusively for themselves or for the company associated with the account. The image and its usage rights/licences cannot be transferred or given to third parties not connected to the acquiring company for any reason.
It is strictly forbidden to upload Fatamadrina’s images to print-on-demand platforms or similar services.
Account
To proceed with purchases, it is necessary to create a personal account and provide some data, which will be processed according to the privacy policy available here.
All data provided by the user must be truthful, and it is the user's responsibility to keep it up to date. We reserve the right to verify the authenticity of the accounts created.
The account will remain active as long as the user is our client and places orders. We will delete the account after 12 months without receiving any order or communication from the user. An email will be sent shortly before the 12-month period expires, notifying the user of the imminent deletion of their account and associated personal data.
We reserve the right to delete any account that violates these Terms and Conditions or that we consider to be fake or at risk of fraud.
Monthly Newsletter
On the website, there is the possibility to subscribe to a newsletter that Fatamadrina sends once a month. The newsletter is designed for people who work in development or production of children’s products, in particular clothing and textile.
The main purpose of the newsletter is to entertain readers with topics around children apparel (design, styles, inspiration, trends, market, etc.), and to show the designs and activities of the studio.
Moreover, subscribing to the newsletter includes the possibility of accessing some free content reserved for members (for example, graphics or moodboards) and downloading them.
Occasionally, commercial proposals will be sent, for example discounts reserved for subscribers.
Subscription is voluntary and may be proceeded through two paths:
- filling in the form available here on the website;
- by ticking the appropriate box at check-out, during a purchase.
Subsequently, the user will receive an email where she/he has to confirm that she/he wishes to receive email marketing.
The personal data collected will be processed according to the Privacy Policy.
In each monthly email there is a link to unsubscribe, in case a subscriber no longer wishes to receive the monthly newsletter.
Payment methods
The following payment methods are available on the website:
- Credit cards: Visa, Mastercard, Maestro.
- PayPal
- Payment apps: Shop Pay, Google Pay, Apple Pay.
- Bank transfer: immediately after placing the order, the client must contact Fatamadrina to obtain the bank details and make a bank transfer for the amount equivalent to the ordered products, specifying the order number (#FM-xxxx) in the payment reference. Once Fatamadrina receives the payment on its bank account, a link to download the purchased products will be sent to the client.
In the case of purchasing products with exclusive rights/licences, these will be hidden from sale at the time of the order, ensuring that no other users can purchase them..
When purchasing consultancy packs, the client will be contacted by Fatamadrina immediately after the payment is credited to the bank account.
- Store credit: if the client wishes to have store credit for themselves or for collaborators using the same account, to use it for future purchases, they can make a bank transfer to Fatamadrina's bank account for the desired amount, specifying in the payment reference: “Store credit request for the account (please specify your account details)”.
Once the transfer has been credited, Fatamadrina will issue store credit for the received amount. The available store credit will be displayed on the client's personal account page under "Profile". Additionally, it will appear as a payment method during checkout.
